Zoning Basics

Contact the  Zoning Administrator (ZA) early to find out if your new Use or new Structure needs a permit. All Dwelling Use (including adding bedrooms) requires a permit, and even interior renovation in a protected area may require a permit in compliance with state guidelines.  After-the-Fact permit fees are tripled, so it’s always best to have a conversation with the ZA when you are considering any land development. The ZA is here to assist you through the process.

The town bylaws state: “no land or building developments as herein defined may commence, nor shall any land or structure be used, be extended in any way, or be occupied, unless a Zoning Permit has been duly issued by the Zoning Administrator.”  Permits expire one year from effective date if the project has not been started and two years from the effective date if the project has not been substantially completed, unless longer times are stated in the permit. While the bylaws are complex, your ZA will help you navigate them and any exemptions, which often have specific caveats or further guidelines under state law.

The ZA is available during office hours, Thursdays from 9am-6pm, although only by appointment after 4pm on the 2nd and 4th Thursdays each month due to Select Board schedules.  An appointment is always advised as the ZA is often on site visits, so feel free to email or call to set up an appointment.  Email will be checked Tuesday through Thursday.  You can call the ZA directly at 802-212-1738, although emails are the preferred and quickest way to get your questions answered: Zoning@MarlboroVT.us
